{"id":1069,"date":"2025-08-01T16:00:00","date_gmt":"2025-08-01T14:00:00","guid":{"rendered":"https:\/\/blog.jobcodehr.com\/?p=1069"},"modified":"2025-08-20T16:04:37","modified_gmt":"2025-08-20T14:04:37","slug":"unfair-dismissal-cap-on-compensation-of-six-months-of-salary-for-unfair-dismissal-removed-for-small-businesses","status":"publish","type":"post","link":"https:\/\/blog.jobcodehr.com\/en\/unfair-dismissal-cap-on-compensation-of-six-months-of-salary-for-unfair-dismissal-removed-for-small-businesses\/","title":{"rendered":"Unfair dismissal: cap on compensation of six months of salary for unfair dismissal removed for small businesses"},"content":{"rendered":"\n<p>Ruling no. 118\/2025 by the Italian Constitutional Court upheld the objections raised by the Court of Livorno and declared <strong>unconstitutional <\/strong>Article 9(1) of Legislative Decree no. 23\/2015, <strong>insofar as it imposed a maximum cap of six months\u2019 salary <\/strong>\u2013 calculated on the employee\u2019s final salary used for severance pay purposes \u2013 as compensation for employees unfairly dismissed by employers with no more than 15 employees per production unit or fewer than 60 employees in total.<\/p>\n\n\n\n<p>The Court indicated that introducing a rigid and absolute ceiling on compensation \u2013 regardless of the severity of the unlawful dismissal \u2013 results in a limitation on such compensation that is so restrictive that it prevents judges from applying, in determining compensation, the principles of individual assessment, adequacy and appropriateness. <\/p>\n\n\n\n<p>In the Court\u2019s view, such rigidity would also undermine the ability of the compensation to act as a deterrent against unlawful conduct by employers.<\/p>\n\n\n\n<p>Due to the Constitutional Court\u2019s ruling, the cap of six months of salary introduced by Legislative Decree no. 23\/2015 is no longer applicable. <\/p>\n\n\n\n<p>The compensation currently due in the event of unfair dismissal is now to be understood as falling within a new range of 3 to 18 months of salary, which corresponds to half the range of limits for businesses with more than 15 employees.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ruling no. 118\/2025 by the Italian Constitutional Court upheld the objections raised by the Court of Livorno and declared unconstitutional Article 9(1) of Legislative Decree no. 23\/2015, insofar as it imposed a maximum cap of six months\u2019 salary \u2013 calculated on the employee\u2019s final salary used for severance pay purposes \u2013 as compensation for employees [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":429,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[26,22],"tags":[64],"class_list":["post-1069","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-featured-news","category-regulatory-news","tag-unfair-dismissal"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.2 -
